In the absence of any compelling urgency and with other alternatives available, defendant's actions in transporting plaintiff, a pre-trial detainee, in a small, unsanitary dog cage was excessive in relation to the goal of preventing his escape, and an inference may be drawn that the officer's conduct amounted to punishment; district court did not err in denying officer's motion for summary judgment based on qualified immunity as the unconstitutionality of the conduct should have been obvious based on both common sense and prior general case law.
